1. Who we are
This website, littlefoodpassport.com, is operated by Smart Seasons, LLC DBA Little Food Passport ("Little Food Passport," "we," "us," or "our"), a California limited liability company. These Terms of Service ("Terms") apply to everyone who visits our website or buys our products. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.
2. Who can use the site
Our site and products are designed for parents, caregivers, and educators. You must be at least 18 years old, or the age of majority where you live, to place an order. Children may use our booklets and stickers with the guidance of a parent, caregiver, or teacher, but the site itself is not intended for children to use on their own.
3. Our products are not medical or nutrition advice
Little Food Passport is an activity and play-based tool that encourages children to explore foods by looking, smelling, touching, and tasting at their own pace. It is not medical, nutritional, or therapeutic advice, and it is not a treatment for any feeding disorder, eating disorder, or medical condition. Results vary from child to child. If you have concerns about your child's eating, growth, weight, or nutrition, or if mealtimes involve gagging, choking, distress, or very limited food acceptance, please talk with your pediatrician or a qualified feeding specialist.
4. Food, allergies, and supervision
We do not sell, prepare, or provide any food. Parents, caregivers, and families choose every food used with our products and are solely responsible for it, including checking for allergies, intolerances, dietary restrictions, and choking hazards, and for preparing food in a safe, age-appropriate way. An adult should supervise children at all times during food exploration activities and when using stickers, which may be a choking hazard for young children.
5. Classroom and educator use
Our Classroom Edition is built on a family-provided food model: schools and programs do not purchase, prepare, or serve food as part of the activity. Schools, programs, and educators using our products are responsible for following their own policies, including allergy, wellness, and parent communication policies. Bulk and classroom orders may be subject to additional terms we provide in writing at the time of the order.
6. Orders, pricing, and payment
All prices are listed in US dollars and do not include taxes or shipping unless stated. We work to describe and price our products accurately, but errors can happen. We reserve the right to correct errors, update prices, limit quantities, and refuse or cancel any order, including after it is placed. If we cancel an order you have already paid for, we will refund you in full. Payments are processed securely through Shopify and its payment partners; we do not store your full card details. Your order is accepted when we ship it.
7. Shipping, returns, and refunds
Shipping is covered by our Shipping Policy, and returns and refunds are covered by our Refund Policy. Both are part of these Terms.
Refunds are available only for products returned unused and in their original condition, and all return shipping costs are at the buyer's expense. If an order arrives damaged, defective, or incorrect, we will cover the cost of a replacement or refund, including shipping, and no return is needed.
8. Product colors and images
We do our best to show our products accurately. Colors and details may look slightly different depending on your screen and printing variation.
9. Our content and intellectual property
Everything on this site and in our products, including the Little Food Passport name and logo, booklet designs, illustrations, sticker designs, characters, videos, text, and activities, belongs to Smart Seasons, LLC DBA Little Food Passport or our licensors and is protected by copyright, trademark, and other laws. When you buy a product, you may use it for your own personal, family, or classroom use. You may not copy, reproduce, scan, resell, distribute, or create derivative products from our materials, or use our name or characters for commercial purposes, without our written permission.
10. Reviews, comments, and content you share
If you post a review, photo, comment, or other content about our products, or tag us on social media, you confirm that you have the right to share it and that it is honest and reflects your own experience. You give us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with our business, including on our website and social media. We will not post a photo of an identifiable child without permission from their parent or guardian. Please do not share content that is unlawful, misleading, or that includes another person's private information.
11. Acceptable use
You agree not to misuse the site, including by attempting to gain unauthorized access, interfering with its operation, using automated tools to scrape content, or using it for any unlawful purpose.
12. Third-party links and services
Our site may link to other websites or services we do not control. We are not responsible for their content, products, or practices.
13. Disclaimer
Our site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that your child will eat or accept any particular food.
14. Limitation of liability
To the fullest extent allowed by law, Smart Seasons, LLC DBA Little Food Passport and its owners, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or our products, including any reaction to food chosen by you or your family. Our total liability for any claim related to a product will not exceed the amount you paid for that product. Some states do not allow certain limitations, so some of these may not apply to you.
15. Indemnification
You agree to hold harmless Smart Seasons, LLC DBA Little Food Passport from claims arising from your misuse of the site or products or your violation of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Please contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association in Orange County, California, except that either party may bring an individual claim in small claims court.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continuing to use the site after changes means you accept the updated Terms.
